1 - Describe the concept of Judicial Review in the early 1800s. Why it is important?

2 - Describe the concept of Popular Sovereignty as it was used in the years leading up to the Civil War.

1) Judicial Review was established by Supreme Court Head Justice John Marshall during the presidency of Thomas Jefferson. It established the Supreme Court's power to stop a law from being passed if they find the law unconstitutional. This power allows the judicial branch to check the powers of the executive and legislative branches. This power helps prevent any branch of government from abusing their power.



2) Popular Sovereignty was the method of dealing with slavery in new established states, like Kansas and Nebraska. This method let a majority vote decide if that state would be a slave state or a free state.

okay umm... 1. Judical review is the inforement of the law. In the 1800's it was the being of the constitution, a being to the a way of conducting themselves. Rules where inforced hard to show this is how it will be u can't just get up and do ur own thing now that we are the united states.

2. In U.S. history, the terms popular sovereignty and the equivalent but more disparaging squatter sovereignty refer generally to the right claimed by the squatters, or actual residents, of a territory of the United States to make their own laws. The most controversial aspect of sovereignty was the choice of residents to accept or reject slavery. The idea was championed by Stephen A. Douglas and provided a means to delay dealing with the larger issue. It was first proposed by Vice President George Dallas in 1847 and was popularized by Lewis Cass in his 1848 presidential campaign. The doctrine was incorporated into the Compromise of 1850 and four years later was an important feature of the Kansas-Nebraska Act.
